The Mayor called the meeting to order at 7:30 p.m
MINUTES for the meeting of March 12, 2008 meeting were approved.
CLAIMS for March, 2008 were presented as detailed in the Abstract of Vouchers in the amount of $92,294.66. After review, the Board approved all for payment.
BUDGET TRANSFERS were requested by the Village Clerk and are appended to these minutes.
JUSTICE REPORT for January, 2008 was submitted and stated revenues in the amount of $10,110. The State of New York has mandated that every court has a yearly audit of their records. Deputy Mayor Jaronczyk offered to perform the audit with the assistance of the Village Clerk.
POLICE REPORT for March, 2008 was distributed to the Board. During the month of March, the following activity was noted:

The Mayor introduced Hon. Judith Bosworth, Nassau County Legislator, 10th Legislative District, to the Board and those residents in attendance. The Mayor requested the Village Clerk to send all correspondence concerning the intersection at Park Avenue and Port Washington Boulevard to the Hon. Bosworth’s office for her review.
BUILDING DEPARTMENT
The Building Inspector, Tony DiProperzio, reported to the Board on application #6302 for Mrs. Hiltveit, 353 Park Avenue to install a gate and fence on the side yard of her property. The Board unanimously approved the application.
COUNSEL REPORT / COURT MATTERS
The Village Attorney presented to the Board drafts of the two local laws to be introduced.
Proposed Local Law #1 –2008 – entitled “Temporary Structures”. The Board discussed the proposed local law and it was moved by Mayor Nicolaides, seconded by Trustee Phillips and unanimously carried that a public hearing would be scheduled for May 14, 2008 at 7:30 pm on the Local Law #1- 2008.
Next the Board discussed proposed Local law #2, 2008 amending Section 92-4 of the Code of Munsey Park regarding “The Resubmission of Construction Plans”. The Board discussed the proposed local law and it was moved by Mayor Nicolaides, seconded by Trustee Puttre and unanimously carried that a public hearing would be scheduled for May 14, 2008 at 7:30pm on the Local Law #2- 2008.
SGA FAIR
The Clerk advised the Board that the SCA Fair would be held at the Munsey Park School on May 3, 2008, from 9:00 A.M. to 5:00 P.M. Parking will be as it has been in the past.
ANNUAL MEETING
The Mayor reported that the Oath of Office had been taken by the following, elected at the Annual Election on March 18, 2008:

Trustee Elaine R. Phillips 2 years
The Mayor reported that a total of twenty-one (21) voters had presented themselves for voting at the Annual Election.
For the information of the Board, the Mayor referred to various sections of the Village Law of the State of New York and the Zoning Ordinance for the Village of Munsey Park concerning the action to be taken.
It was moved by Trustee Phillips and seconded by Trustee Jaronczyk that the following resolution be adopted:
BE IT RESOLVED, that the Mayor and Board of Trustees serve without compensation for the current fiscal year and,
BE IT FURTHER RESOLVED, that pursuant to §4-400 of the Village Law of the State of New York the Board of Trustees approves the following appointments, by the Mayor:
Lenore Regan, re-appointed DEPUTY CLERK / COURT CLERK for a term of one (1) year, expiring on the first Monday of April, 2009.
Anthony S. DiProperzio, re-appointed BUILDING INSPECTOR for a term of one (1) year, expiring on the first Monday of April, 2009.
Francis J. Coughlin Jr. re-appointed ACTING JUSTICE for a term of one (1) year, expiring on the first Monday of April, 2009; and
BE IT FURTHER RESOLVED, that James Bradley and Michelle Prior of the firm of Ackerman, Levine, Cullen, Brickman & Limmer, LLP be retained as Village Attorney and Prosecutor, and are hereby authorized to proceed as outlined in the proposal dated February 13, 2008, a copy of which will be made a part of these minutes; and
BE IT FURTHER RESOLVED, that the firm of Skinnon and Faber Certified Public Accountants; P.C., be retained to provide accounting services as outlined in the proposal dated January 11, 2008, a copy of which will be made a part of these minutes; and
BE IT FURTHER RESOLVED that Deborah B. Miller be re-appointed as Chairperson of the Board of Zoning Appeals for the 2008-2009 official year; and
BE IT FURTHER RESOLVED, that the Manhasset Press, a newspaper published in Manhasset, Town of North Hempstead, be, and hereby is, designated OFFICIAL NEWSPAPER for the official year 2008-2009, pursuant to §4-412 of the Village Law of the State of New York; and
BE IT FURTHER RESOLVED, that the Clerk-Treasurer be authorized to make payment in advance of audit for public utility services, postage, freight and express charges. Such claims must be presented for audit at the next regular meeting; and
BE IT FURTHER RESOLVED, that Capital One, and MBIA Class be, and hereby are, designated OFFICIAL DEPOSITORIES for the current official year and that the Clerk-Treasurer be authorized to deposit funds as outlined in the Investment Policy adopted by the Board of Trustees on January 14, 1987 and amended June 12, 1996.
BE IT FURTHER RESOLVED that meeting dates for the 2008/2009 official years is as follows:

BE IT FURTHER RESOLVED that all meetings of the Village Board shall begin at 7:30 p.m; and
BE ITFURTHER RESOLVED, that the Board of Zoning Appeals meetings shall be held on the first Monday of each month, at 7:30 pm., provided that they have business to transact; and
BE IT FURTHER RESOLVED, that the Board of Trustees has determined that attendance by certain municipal officials and employees at one or more conferences and meetings during the coming official year will benefit the municipality the Clerk-Treasurer or Deputy Clerk/Court Clerk be, and hereby is authorized to attend the regular meetings of their respective state, county, and local associations; and
BE IT FURTHER RESOLVED, that the Court Clerk be authorized to attend the annual Court Clerks Training School; and
BE IT FURTHER RESOLVED, that Zoning Board of Appeals and the Mayor and Board of Trustees be authorized to attend any Training Schools; and
BE IT FURTHER RESOLVED, that the Village Justice and Acting Village Justice be authorized to attend state or county continuing judicial education programs; and
BE IT FURTHER RESOLVED, that the Board of Trustees shall approve reimbursement to such officers for actual expenses and/or for mileage at the rate per mile set by the Internal Revenue Service for travel in their personal automobiles to these meetings, schools, and conferences; and
Pursuant to §4-400 of the Village Law of the State of New York, Mayor Nicolaides appointed Albert T. Jaronczyk as Deputy Mayor for the 2008-2009 Official Year.
The Mayor made the following assignments to the Trustees for various responsibilities of Village government for the 2008/2009 official years: This will be reviewed and may be changed during the next few months.

2008 – BUDGET HEARING
The Public Hearing for the purpose of considering the Budget for the fiscal year beginning June 1, 2008 and ending May 31, 2009, for the Incorporated Village of Munsey Park was called to order by Mayor Nicolaides.
The Clerk stated that she had posted the required Notice of Public Hearing and advertised the notice in the official newspaper. An Affidavit of Publication from the Manhasset Press was placed in the record of the hearing.
Mayor Nicolaides made the following statement:
“The purpose of this public hearing is to review, and hopefully adopt, the budget for the fiscal year beginning June 1, 2008 and ending May 31, 2009. The village’s appropriations are $1,586,440.00 with revenues at $612,943.00 and an anticipated taxable value of $973,497.00, an increase from last year.
A tax rate cannot be established at this time until the Department of Assessment gives the village the breakdown for each of our three classes, which include residential, commercial and utilities.
The final tax rate and tax levy will be an agenda item for the May 14, 2008 meeting, of the Board of Trustees.
The Mayor asked the residents in attendance if they had any questions or wished to make any statements.
On a motion made by Deputy Mayor Jaronczyk, seconded by Trustee Phillips and unanimously carried, the hearing was closed.
NEWSDAY CIRCULARS
Mr. Thompson from 339 Park Avenue complained about the Newsday circulars that are thrown on every resident’s property either on the driveway or on the sidewalk. The papers are unsightly and present an open invitation that the house is empty for potential burglars. The Mayor requested that the Village Clerk contact Newsday to make sure that this complaint is handled expeditiously.
WATER MAIN BREAK
Christopher Clement of Dvirka & Bartilucci advised the Board that the area of Park Avenue repaved after the water main break will have to be redone as the job was not acceptable. Mr. Clement will let the Board know of the approximate timetable of the work
2007 ROAD IMPROVEMENTS
Christopher Clement from the engineering firm of Dvirka & Bartilucci advised the Board that the punch list for Phase I of the road improvements has begun and should be completed in approximately three to four weeks. The bid specs for the Spring 2008 Road Improvement should be ready next month.
COPLEY POND
Ken Pritchard of Divirka & Bartilucci presented drawings of the proposed work for the refurbishing of Copley Park Pond. Certain areas of the pond and sidewalks are deteriorating and in need of repair. The walkways would be made of asphalt and measure approximately five feet in width with brick edging. After a lengthy discussion with those residents in attendance, it was decided that the walkways should be no wider than four feet. Next was a discussion on the existing lighting. The Mayor questioned if the Village needs to add additional lampposts with subdued lighting and a timer or utilize what is presently in the park. Mr. Jim McGivney, a former trustee, advised the Board that the pond is 3 ½ feet deep and there are several catfish, frogs and turtles in the pond. The village arborist, Richard Gibney, was scheduled to be in attendance to talk about the landscape design but did not appear. Due to his absence, the Mayor requested that this discussion be continued at the May meeting of the Board of Trustees.
VERIZON COMPLAINT
Mr. Vincent Syracuse, 76 Trumbull Road, complained that Verizon has a pole in the rear of his property but the right-of-way to the pole, he believes, is on his neighbor’s property. Instead of using the neighbor’s property, the Verizon workers are coming onto Mr. Syracuse’s property leaving the back gates open and causing a severe inconvenience to both his wife and him. The Mayor requested that the Village Clerk address this situation and make sure that Verizon is advised of the Villages’ hours for work by contractors.
LUTHERAN CHURCH PARKING
Maria Leonardopoulos, 7 Sully Drive, addressed the Mayor & Board of Trustees, she thanked the road crew for their exceptional job on cleaning all the snow & ice during the winter storms. She then complained about an on-going problem with parking at the Lutheran Church. Presently the Church rents space to approximately 30 to 40 cars belonging to workers from the Nubest Salon in Manhasset. A limousine “5 Star Limo Service” picks up the employees in the morning around 9:00 am and drops them off in the evening around 6:30 pm. The cars speed into the lot so as not to miss the limo causing unsafe conditions to any children or adults walking in the area. The Mayor advised Mrs. Leonardopoulos that he would meet with the Church and report back on the outcome.
There being no further business, the meeting was declared adjourned at 11:15 p.m.
